ARTICLE 16. RIGHTS AND OBLIGATIONS OF INSURED PERSONS
 
REGULATION OF THE GOVERNMENT OF THE RUSSIAN FEDERATION N 186 OF MARCH 6, 2013 "ON APPROVAL OF THE RULES FOR RENDERING MEDICAL ASSISTANCE TO FOREIGN CITIZENS ON THE TERRITORY OF THE RUSSIAN FEDERATION"

 

1. This procedure for visiting by clergy of patients who are undergoing inpatient treatment at the Federal State Budgetary Institution "FTSSSH" of the Ministry of Health of Russia (Astrakhan) (hereinafter referred to as the Center) has been developed in order to respect the patient's right to admit a clergyman to him and perform religious rites when receiving medical care in stationary conditions, provided for by the Federal Law of November 21, 2011 No. 323-FZ "On the basics of protecting the health of citizens in the Russian Federation."

2. Interaction with a religious organization in order to exercise the rights of patients to admit a clergyman and perform religious rites is carried out by a responsible officer.

3. Visits by clergy to patients in the inpatient departments of the Center in the provision of planned medical care, as well as the performance of religious rites, are carried out during the visiting hours established by this order.

4. For patients staying in the departments of the Center receiving medical care in the field of resuscitation and intensive care, as well as for patients staying in the inpatient departments of the Center, in case of a threat to the life of these patients, visits by clergy to patients are carried out without taking into account the visiting hours established by the order of the Center.

5. Visits to clergy are carried out in compliance with the requirements of the anti-epidemiological regime, including the use of appropriate personal protective equipment.

6. In case of resumption of measures to ensure the sanitary and epidemiological well-being of the population in the Astrakhan region due to the spread of a new coronavirus infection (COVID-19), clergy who have been vaccinated against coronavirus infection or who have a negative result of a PCR test for coronavirus are allowed to visit the patients of the Center. infection not older than 72 hours.

In the case when the patient is in an extremely serious / terminal condition, the clergyman can be admitted to the patient once without complying with the requirement established in the first paragraph of this clause. In this case, the subsequent admission of this clergyman is carried out in compliance with the requirement established in the first paragraph of this clause.

The time for a visit by a clergyman to a patient should not go beyond the visit time set at the Center: daily, from 15:30 to 19:00 local time. On non-working days, weekends and holidays - visits to patients additionally from 10:00 to 12:30 local time.

7. If a clergyman is admitted to the anesthesiology and intensive care unit to see patients with a diagnosis that implies an acute respiratory infection, the responsible officer must warn the clergyman about the risk of possible infection with an acute respiratory infection.

8. The responsible officer is obliged to brief the clergyman on the rules for visiting patients at the Center, as well as fire safety when performing religious rites using church candles and other flammable means.

9. Upon receipt of information from the patient about the desire to meet with the clergyman, the medical officer (attending / doctor on duty / nurse) makes an appropriate entry in the patient's medical records and transfers this information to the responsible employee within 1 (one) working day from the moment the information is received from the patient , and in case of a threat to life within 2 (two) hours.

9.1. The responsible employee of the Center notifies the religious organization within 2 hours of the need to respect the patient's right to admit a clergyman to him and perform religious rites when receiving medical care in a hospital, provided for by Article 19 of the Federal Law of November 21, 2011 No. 323-FZ "On the Basics of Health Protection citizens in the Russian Federation.

9.2. The responsible officer of the Center, if notified by a religious organization, notifies the security about the arrival of the clergyman within 1 hour and 30 minutes.

9.3. After the arrival of the clergyman at the checkpoint, the guards pass the information on the clergyman to the responsible person.

9.4. The responsible officer arrives at the security post and, after the clergyman presents identification documents, ensures:

- reconciliation of data on the clergyman with the list of clergymen who interact with the Federal State Budgetary Institution "FTSSSH" of the Ministry of Health of Russia (Astrakhan) in order to exercise the rights of patients to admit a clergyman and perform religious rites;

- accompanying the clergyman to the patient, as well as providing the clergyman with personal protective equipment through the nurse of the inpatient department in which the patient is located, in agreement with the head nurse of the department (head of the department) in which the patient is located;

- briefing a clergyman on the requirements of the anti-epidemiological regime, including the use of appropriate personal protective equipment;

- verification (in case of resumption of measures to ensure the sanitary and epidemiological well-being of the population in the Astrakhan region due to the spread of a new coronavirus infection (COVID-19)) whether a clergyman has been vaccinated against coronavirus infection or a negative result of a PCR test for coronavirus infection, not long ago over 72 hours.

9.5. In case of non-compliance of the clergyman with the conditions of clause 9.4. Order, the responsible officer does not allow the clergyman to the territory of the Center.

9.6. If the clergyman complies with the conditions of clause 9.4. of this Procedure, the responsible officer shall immediately escort the clergyman to the patient in order to exercise the patient's right to admit a clergyman to him and perform religious rites when receiving medical care in a hospital, provided for by Federal Law No. Federation".

10. If a clergyman is invited by the patient’s representatives in case of a threat to the patient’s life, the patient’s right to admit a clergyman to him and perform religious rites when receiving medical care in a hospital, provided for by the Federal Law of November 21, 2011 No. Russian Federation” is subject to implementation only if the religious organization complies with the obligation to notify the responsible employee of the visit of the clergyman at least two hours in advance, who provides the necessary assistance in organizing the visit of the clergyman to the patient and compliance with the requirements established by this Procedure.

11. The number of visits to the patient by the priest is not limited, but should be no more than 1 (one) time per day.12. After exercising the patient's right to have access to a clergyman and performing religious rites while receiving medical care in a hospital, the clergyman informs the responsible officer about this and the responsible officer escorts the clergyman to the exit from the institution.
